Terms of Service — NexTrend

Agreement

These Terms of Service ("Terms") govern your access to and use of NexTrend (the "Service"), operated by NexTrend ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Beta notice: NexTrend is currently in beta. Features, pricing, and availability may change. The Service is provided on an evolving basis.

Eligibility

You must be at least 16 years old and able to form a binding contract. You are responsible for ensuring your use complies with applicable laws in your jurisdiction.

Description of the Service

NexTrend provides product intelligence for ecommerce entrepreneurs, including:

NexTrend Score and product analysis
Opportunity Brief recommendations
Personalized radar and watchlist
Decision Center and intelligent alerts (plan-dependent)
Public catalog preview and discovery tools

NexTrend provides information and recommendations, not financial, legal, or business advice. You are solely responsible for decisions you make based on the Service.

Accounts

You must provide accurate registration information.
You are responsible for maintaining the security of your account credentials.
You must notify us promptly of unauthorized access.
One person or organization may not maintain multiple free accounts to circumvent plan limits.

Plans and billing

Free plan: limited analyses, watchlist, and features as described on the pricing page.
Paid plans (Pro, Business): additional features, higher limits, and billing as selected at checkout.
Paid subscriptions are processed by Stripe. By subscribing, you authorize recurring charges according to your selected plan and interval.
Prices may change with reasonable notice. Changes apply to subsequent billing periods.

Acceptable use

You agree not to:

Reverse engineer, scrape, or abuse the Service or its APIs
Use automated means to extract data beyond normal product use
Circumvent plan limits or authentication
Upload malicious code or interfere with Service operation
Use the Service for unlawful purposes
Misrepresent NexTrend scores or recommendations as guaranteed outcomes

We may suspend or terminate accounts that violate these Terms.

Intellectual property

The Service, including software, design, NexTrend Score methodology, and content (excluding third-party product data), is owned by NexTrend or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

Product names, images, and marketplace data belong to their respective owners.

Third-party services

The Service integrates with third parties (Clerk, Stripe, Amazon catalog sources, etc.). Your use of those services may be subject to their terms. We are not responsible for third-party services.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

Accuracy or completeness of product data
That recommendations will result in commercial success
Uninterrupted or error-free operation
That catalog data is real-time (see Outdated badges in product)

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXREND SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $100 IF YOU USE THE FREE PLAN.

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.

Indemnification

You agree to indemnify NexTrend against claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Termination

You may delete your account at any time through account settings or by contacting us.
We may suspend or terminate access for violation of these Terms or for operational reasons with reasonable notice where practicable.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (disclaimers, liability limits, dispute resolution) survive.

Governing law

These Terms are governed by the laws applicable to NexTrend's place of establishment, without regard to conflict of law principles. Disputes shall be resolved in the courts of competent jurisdiction unless mandatory consumer protection laws in your country require otherwise.

Changes

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified via the Service or email.
